Biotech Lab Consulting: Moving From Research to CLIA-Certified Testing

A biotech lab needs a CLIA certificate once it reports patient-specific results for diagnosis, prevention, treatment or health assessment. Research-only testing with no patient-specific reporting falls outside CLIA. Moving to clinical testing means choosing a certificate, naming a qualified director, validating each test and building QC, PT and records.

Research testing or clinical testing?

CMS says CLIA applies when patient-specific results are reported from the lab to another entity and are made available for diagnosis, prevention, treatment or health assessment (CMS: Research testing and CLIA (PDF)). The regulation's exception for research labs is in 42 CFR 493.3(b)(2) (42 CFR Part 493 (eCFR)).

Common biotech situations to sort out:

  • Discovery or research only. Results are not returned to individuals or their clinicians. Usually outside CLIA.

  • Returning results to participants or clinicians. CLIA applies to that testing.

  • Launching a lab-developed or modified test. Needs a CLIA certificate that covers its complexity, and performance specifications established under 493.1253(b)(2).

Choosing the certificate and accreditation path

Most biotech clinical assays are moderate or high complexity. That means a Certificate of Compliance (surveyed by the state agency) or a Certificate of Accreditation (inspected by an approved accreditor such as CAP or COLA). See CLIA certificate types. Some states also require their own lab license, so check your state before you build. New York has its own permit program (New York lab licensing).

Building the clinical lab

  • People. A laboratory director who meets 493.1443 for high complexity or 493.1405 for moderate complexity, plus technical and general supervisors or a technical consultant as required.

  • Validation. Accuracy, precision, analytical sensitivity and specificity, reportable range and reference intervals, documented before patient reporting. See NGS assay validation for a sequencing example.

  • Quality system. Procedure manual, QC, PT or alternative assessment, competency, and corrective action.

  • Billing readiness. If you will bill for testing, plan coding and payer enrollment early (clinical lab billing).

Checklist

  • [ ] Decide which assays will report patient-specific results.

  • [ ] Separate research and clinical workflows, records and specimens.

  • [ ] Pick the CLIA certificate type and, if desired, an accreditor.

  • [ ] Check state licensure (including New York, if you test NY specimens).

  • [ ] Name a qualified laboratory director and required supervisors.

  • [ ] File the CMS-116 application.

  • [ ] Establish or verify performance specifications for every assay.

  • [ ] Write the procedure manual and QC plan.

  • [ ] Enroll in PT or set up alternative performance assessment.

  • [ ] Document training and competency before go-live.

Frequently asked questions

Does a biotech company need CLIA?

Only for testing that reports patient-specific results for diagnosis, prevention, treatment or health assessment. Pure research without that reporting is outside CLIA under 42 CFR 493.3(b)(2).

Can our research lab and clinical lab share space?

Many organizations do this. The clinical testing has to meet Part 493 requirements, so keep clinical procedures, records and personnel documentation clearly defined.

What certificate does a lab-developed test need?

LDTs are generally moderate or high complexity, so the lab needs a Certificate of Compliance or a Certificate of Accreditation covering that complexity.

Who can direct a biotech CLIA lab?

The director must meet the qualifications in 42 CFR 493.1443 for high-complexity testing. We offer laboratory director services and can review the qualifications of directors you are considering.

Do we need CAP accreditation?

CLIA does not require accreditation. Labs can use a Certificate of Compliance with state surveys, or choose an accreditor such as CAP or COLA for a Certificate of Accreditation.

Can you help with billing?

Yes. We support clinical lab billing as part of setting up a compliant lab.
