Upgrading From CLIA Waived to Moderate or High Complexity Testing

Why practices expand beyond waived testing

Waived tests are simple to run and need minimal oversight, so many practices start there. As patients ask for a broader test menu, some practices look at moderate or high complexity testing to keep more work in-house and shorten turnaround times.

Step 1: Choose your test menu and confirm each test's complexity in the FDA CLIA database

List the tests you want to add. Then look up each one in the FDA CLIA database to confirm its complexity category. The category determines which certificate and personnel requirements apply.

Step 2: Pick the certificate path

The certificate you need depends on who surveys your lab:

• A PPM certificate covers microscopy by providers.

• A Certificate of Compliance means state agency surveys.

• A Certificate of Accreditation means a CMS-approved accreditor surveys your lab.

Step 3: Personnel

• Moderate complexity needs a qualified lab director, technical consultant, clinical consultant and testing personnel. High complexity adds a technical supervisor and general supervisor.

• Under the rule effective 12/28/2024, a physician directing moderate complexity testing must be board-certified in anatomic or clinical pathology, or have at least 1 year directing or supervising nonwaived testing plus at least 20 CE credit hours covering director responsibilities (§493.1405(b)(2)). Many practice owners don't meet this yet, which is where an outside director helps.

• The director must be onsite at least every 6 months, with at least 4 months between visits, and document those visits (§493.1407(c)).

• One person can direct no more than five labs (§493.1407(d) for moderate complexity, with a parallel limit for high complexity in §493.1445).

Step 4: Apply

Submit a CMS-116 to your state agency to change the certificate type and pay the fees. A Certificate of Registration lets you start nonwaived testing until your survey. Check state licensure rules too.

What changes day to day compared with waived testing

QC frequency, documentation, PT and surveys every 2 years.

PPM: what it covers

PPM covers wet mounts, KOH preps, pinworm exams, fern tests, post-coital qualitative exams, urine sediment, nasal smears for granulocytes, fecal leukocytes and qualitative semen analysis. It is performed by physicians, midlevel practitioners or dentists during the patient visit.

Can we start moderate complexity testing on our Certificate of Waiver?

No. You need a Certificate of Registration (or another nonwaived certificate) first.

Can our physician be the lab director?

Possibly, if they meet §493.1405 (or §493.1443 for high complexity) and any state licensure rules. Many don't yet, and an outside qualified director is common.

Do we need a medical technologist on staff?

Testing personnel must meet the qualifications for the complexity level (§493.1423 / §493.1489). Requirements differ by complexity and state.

What's the difference between a Certificate of Compliance and a Certificate of Accreditation?

Who surveys you: the state agency or a CMS-approved accreditor. Both are on a 2-year cycle.
